The offer and sale of Products, as well as the provision of the Services, on our E-commerce site https://magnogaudiofirenze.it ("the Site") are governed by these General Terms and Conditions, which, together to the order form, constitute the contract (hereinafter the "Contract") governing the relations between the site owner, ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA with registered office: Via Montebello 84, operational headquarters: via Maggio 45r p. These General Conditions are drawn up in compliance, in particular, with the legislation on distance contracts between professionals and consumers pursuant to Legislative Decree n. 206/2005 ("Consumer Code"), of Legislative Decree n. 70/2003 (Implementation of Directive 2000/31 / EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce) and Legislative Decree n. 59/2010 and subsequent amendments

The Contract is subject to modifications by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, it being understood that, in the relationship with the Customer, the rules provided for by the Contract published on the Site will be applied at the time the order is placed by the Customer.

1. Definitions

The terms and phrases listed below have the meaning indicated below, it being understood that the terms defined in the singular are also defined in the plural and vice versa:

“Reserved Area”: means that part of the Site, given for exclusive use to the Customer, through which the same can, after authenticating with their Account, access specific functions made available by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA;

“Client”: means any Consumer who purchases one or more Products through E-commerce, acting in accordance with the contract;

“Consumer”: indicates any natural person who acts on the Site for purposes unrelated to any entrepreneurial, industrial, commercial, craft or professional activity carried out, with an age greater than or equal to 18 years;

2. Object of contract

In consideration of its commercial policy, ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA reserves the right not to process orders from subjects other than Consumers or orders that do not comply with its commercial policy, or that appear anomalous or fraudulent, at its sole discretion judgement, even without providing any notice to the Customer.

In any case, ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA reserves the right not to accept orders that appear anomalous in relation to the quantity of Products purchased or the frequency of purchases made.

The resale, rental, leasing or transfer for any reason whatsoever or for any commercial and / or professional purpose of the Products purchased on the Site is expressly prohibited.

Without prejudice to mandatory provisions of law, if the purchased Product is destined for markets in countries outside the European Union, it will be the Customer's responsibility to communicate in writing to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA all the regulations applicable to the Product in the country of destination, including technical specifications, also relating to product safety, and customs and import regulations. The Customer assumes sole responsibility for any non-compliance of the Product with the aforementioned regulations.

ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA makes available, free of charge, its Services such as:

  • free registration to scheduled events of ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, upon acceptance of particular contract conditions;
  • tracking of purchases made by the User and archiving of the related purchase history;
  • the creation and storage of preferences expressed by the User ("wish list").

If the Customer does not proceed to register as required pursuant to the following clause 3.1. of the Contract, the Customer will not be able to use the Services made available by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA and, therefore, the relative obligations of the Contract will not apply.

3. Conclusion of the Agreement

 

3.1. Purchase products without registration: the Customer may proceed with the purchase of the Products on the Site without registering.

The unregistered customer will not be able to use the free services referred to in art. 2 of these conditions and at the next purchase you will have to re-enter the data at the time of transmission of the order form.

The Customer is in any case required to read the Contract paying particular attention to the clauses governing the right of withdrawal. Qualora il Cliente noti qualsivoglia irregolarità, sarà tenuto a comunicarlo prontamente a ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA .

Con la trasmissione del Modulo d’ordine il Cliente conferma di aver compreso ed accettato il Contratto, nonché le ulteriori informazioni contenute nel Sito.

4. Safety

  4. cannot be purchased online.

8. Prices

The prices of the Products and/or Services and the related delivery costs may be subject to updates and are to be understood as inclusive of VAT, where applicable.

If the price of a Product and/or a Service is discounted according to the discount percentage indicated, this indication will refer to the price charged on the Site the day before the discount.

The prices of the Products and/or Services, including taxes and duties, are indicated in the product sheet. Shipping costs, included in the total cost shown in the Order Form, are charged to the Customer in a variable lump sum based on the overall volume of the shipment. The latter will be free for orders over € 200 for Italy, € 300 for Europe, € 350 for the rest of the world.

The prices of the Products and/or Services are valid until the purchase procedures are completed.

9. Terms of payment

The Customer can make the payment of the price due by:

10. Shipping and delivery of the Products

Shipping is offered worldwide, subject to the legislative restrictions of the destination country.

If the delay in delivery is more than ninety (90) days compared to what is indicated, the Customer will have the right to terminate the Agreement.

11. Verification of the integrity of the product

The Customer is required to verify, at the time of delivery of the Product, that the packaging and/or the packaging and/or the Products are intact, not damaged or altered.

12. Product Warranty Requests

Each Product sold through the Site is subject to the legal guarantee, provided directly by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, within the terms of the law equal to 2 (two) years from the date of delivery.

For this reason, the Customer is required to keep the proof of purchase of the Product.

 13. Guarantees offered

After reporting the lack of conformity, ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA reserves the right to offer the Customer suitable remedies available.

In the event of a lack of conformity, the Customer has the right, without charge, to the replacement or termination of the Contract concluded, in accordance with what is defined below.

  • Replacement

For the purpose of restoring the conformity of the Product, the Customer can request replacement.

ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA may refuse to bring the Products into conformity if replacement is impossible or if the costs it would incur are disproportionate, taking into account all the circumstances of the case.

In order to replace the Product, the Customer must communicate the following information to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA: lot number of the Product; photographs depicting the Product. ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA may reserve the right to request further information from the Customer for the purpose of exercising the right of replacement.

The replacement is carried out:

  3. without significant inconvenience for the customer.

If it is necessary to remedy the lack of conformity by replacing the Products, the Customer must make them available to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, according to the procedures defined by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, who will take back the replaced Products at his own expense.

The shipping costs for the purposes of exercising the guarantees defined here are borne by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA, who may decide, at its own discretion, the carrier to be used and the shipping methods themselves. The Customer, on his part, is required to comply with the shipping conditions defined by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA.

  • Resolution

If the replacement is impossible or excessively expensive, the Customer may request the termination of the Contract by means of a specific communication by registered letter with return receipt or PEC to be sent to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA at the addresses indicated above.

If the Customer terminates the Agreement in whole or in part or in relation to only some of the Products:

  1. a) must return the Products, at the expense of ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA;
  2. b) ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA will refund the Customer the price paid for the Product after receipt of the goods.

 14.Re-credit

Any crediting of sums due under the guarantee will be made by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA within a reasonable time, in accordance with the Contract, using the same tool used by the Customer for the conclusion of the Contract itself, unless the Customer has expressly communicated otherwise to ELLEFFE REPRESENTATION OF LUCA FISICHELLA.

15.Right of withdrawal

The Customer has the right to freely withdraw from the Contract concluded with ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA without indicating the reasons and without any penalty or increase in expenses or costs within fourteen (14) days, starting from the day on which the Customer or a third party, other than courier, acquires physical possession of the Product. The date indicated on the courier's delivery document will prevail.

The right of withdrawal must be exercised by the Customer by sending ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA a written communication, by e-mail or ordinary mail, containing the manifestation of the will to exercise the right of withdrawal as well as:

  • the indication of the order number that gave rise to the Contract from which you intend to withdraw;
  • the Product code;
  • the number of pieces of the ordered Product;
  • Product photography;
  • the date of the order;
  • delivery date;
  • the name of the buyer;
  • the address of the buyer.

In order to comply with the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period which must necessarily be confirmed by registered letter with return receipt or certified e-mail within 48 (forty-eight). subsequent hours.

In case of exercise by the Customer of the right of withdrawal, the latter is required to return the Products to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA without undue delay and in any case within fourteen (14) working days from the date of the notice of withdrawal. The deadline is thus met if the Customer sends back the Products before the expiry of the period of fourteen (14) days from the sending of the notice of withdrawal.

If the Customer withdraws from the Contract, all payments made in favor of ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA will be reimbursed, including the shipping costs incurred, without undue delay and in any case no later than 14 (fourteen) days from the day on which ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA has been informed of the decision to withdraw from the Contract.

Refunds will be made using the same payment method used for the initial transaction, unless the Customer has expressly communicated otherwise to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA.

The refund may be withheld by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA until receipt of the Products or until the Customer demonstrates that he has returned the Products.

The related costs relating to the return of the Products are entirely borne by the Customer.

The Product must be returned intact and in its original packaging. If the Customer exercises the right of withdrawal in a way that does not comply with the methods and terms referred to in this article, he will not be entitled to a refund.

If the Products are returned to ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA by the courier with the cause specified "unknown address", the Customer will be contacted by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA and can choose whether to have the order sent again, if the Product is still available, or have the amount already paid refunded.

The Customer's right of withdrawal is excluded if the Products are:

  1. a) made to measure and / or clearly personalised;

  3. c) are sealed goods which, opened after delivery, do not lend themselves to being returned for reasons of hygiene or health protection;
  4. d) after delivery, by their nature, inseparably mixed with other goods;
  5. e) without lid and / or cap.

 16.Major force

The execution of the services by ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA may be suspended in the event of the occurrence of a fortuitous event or force majeure that prevents or delays its execution. For example, but without limitation, war, riots, uprisings, strikes, pandemics and supply problems attributable to third party suppliers are considered as such. ELLEFFE RAPPRESENTANZE DI LUCA FISICHELLA will inform the Customer of the occurrence of the fortuitous event or force majeure within seven (7) days from the occurrence of the same. In the event that the suspension of the service should be prolonged for a period exceeding 15 days, the Customer will have the possibility to cancel the order placed and will be reimbursed for the amounts already paid.

17. Applicable law, dispute resolution and competent court

The Contract is governed by Italian law.

For any dispute that may arise in connection with the Contract, Customers may activate an out-of-court dispute resolution procedure in compliance with the requirements set out in Articles. 141 and ss. of the Consumer Code. Customers also have the right to use the online dispute resolution procedure available on the European platform https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=IT 

In any case, the Customer has the right to take ordinary action and in this case the mandatory territorial jurisdiction will be that of the judge of the place of residence or domicile of the Customer, if located in the Italian territory.
